Privacy Policy For California Consumers

Under the California Consumer Privacy Act, California consumers have the right:

1. To know what personal information is collected about them. Consumers will have the right to know, through a general privacy policy or notice (and with more specifics available upon request), what personal information Kaman has collected about them, its source, and the purpose for which it is being used.

2. To know whether and to whom their personal information is sold/disclosed, and to opt-out of its sale. Companies that provide or make consumer data available to third parties for monetary or other valuable consideration are deemed to have sold the data and will need to disclose this. Subject to certain exceptions, consumers will then have the further right to opt out of the sale of this information by using the “Do Not Sell My Personal Information” link on the business’ home page, which is required by the Act. Moreover, those 16 years-old and under must opt in to have their information sold. Note that the term “sold” is not limited to the actual sale of privacy information but can be interpreted broadly to include sharing of privacy information with other parties.

3. To request their personal information that has been collected. Consumers will have the right to request certain information from businesses, including the sources from which a business collected the consumer’s personal information, the specific elements of personal information it collected about the consumer, and the third parties with whom it shared that information. The Act requires that businesses provide specific means for consumers to submit these requests, typically a toll-free number and a web link. Once the request is made, businesses must disclose the requested information free of charge within 45 days, with extensions of time available in certain circumstances.

4. To have Kaman delete their personal information. Consumers can request that personal information a business has collected be deleted. Some personal information is exempt from deletion requests, including information under legal hold (until the matter is adjudicated or until the hold is released) and for information that must be retained per legal or regulatory recordkeeping requirements.

5. To not be discriminated against for exercising their rights under the Act. The CCPA gives consumers the right to receive equal service and pricing from Kaman, even if they exercise their privacy rights under the Act. As such, Kaman may not “discriminate” against consumers for exercising these privacy rights. We cannot deny goods or services, charge different prices, or provide a different quality of goods or services to those consumers. There are some exceptions, however, on the service levels that can be provided. It is expected that this definition of “discrimination” will evolve either from guidance from the California Attorney General or case law. It should be noted that even though the Act requires the California Attorney General to provide implementation guidelines, he has publicly stated he is reluctant to do so.

Rights and Requests to Know and Delete

A California consumer has the right to know the information we have collected about the consumer, the right to know the information we have “sold”, or disclosed for a business purpose, and the right to request deletion of their personal information.

 

We will acknowledge within 10 days that we have received your request, and will require information to verify your identity. Read on for more information about these processes.

 

Right to know information collected

You have the right to request disclosure of the personal information we have collected about you. After we have received your request to know, and have verified your identity, we will provide the following:

  • The categories of personal information we have collected about you.
  • The categories of sources from which the personal information is collected.
  • The business or commercial purpose for collecting or selling personal information.
  • The categories of third parties with whom we share personal information.
  • The specific pieces of personal information we have collected about you.

 

Right to know information sold or disclosed for a business purpose

You have the right to request disclosure of the personal information about you were have “sold” or disclosed for a business purpose. After we have received your request to know, and have verified your identity, we will provide the following:

  • The categories of personal information that we have collected about you.
  • The categories of personal information about you that we sold and the categories of third parties to whom the personal information was sold, by category or categories of personal information for each third party to whom the personal information was sold.
  • The categories of personal information about you that we disclosed for a business purpose.

 

Right to request deletion of information

You may request that we delete any personal information which we have collected from you. After we have received your request to delete, and have verified your identity, we will delete your information except as described below, and will direct any service providers which received your information from us to delete your information.

 

We will not delete your personal information, even following a verifiable consumer request, if it is necessary for us or our service providers to maintain the information in order to:

  • Complete the transaction for which the personal information was collected, provide a good or service you requested, or reasonably anticipated within the context of a business’s ongoing business relationship with you, or otherwise perform a contract between us and you.
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity.
  • Debug to identify and repair errors that impair existing intended functionality.
  • Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law.
  • Comply with the California Electronic Communications Privacy Act pursuant to Chapter 3.6 (commencing with Section 1546) of Title 12 of Part 2 of the Penal Code.
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when our deletion of the information is likely to render impossible or seriously impair the achievement of such research, if you have provided informed consent.
  • To enable solely internal uses that are reasonably aligned with the expectations of consumers based on your relationship with us.
  • Comply with a legal obligation.
  • Otherwise use your personal information, internally, in a lawful manner that is compatible with the context in which you provided the information.

 

Process for exercising a request to know or request to delete

In order to submit a request to know or request to delete, please read carefully the information below, so that we can quickly and accurately process your request.

  2. We will notify you within 10 days that we have received your request.
    We will respond to the email or phone number you provided in your request.
     
  3. You will be required to verify your identity. In order to do so, you will need to provide first and last name, email address, and country.

    If you want to designate an authorized agent to make the request on your behalf, you may do that in one of two ways:
    1. Provide written instruction to the Authorized Agent, provide a copy of the written instruction to us, and verify your identity with us
    2. Provide a Power of Attorney, which meets the following requirements, to the Authorized Agent, which the Authorized Agent can provide to us.

      Power of Attorney Requirements:
      • In writing
      • Signed by the person who is designating the authorized agent
      • Specifically granting the authorized agent the ability to make requests to know/delete, or provides a general power of attorney

 

Right to opt out of “sale” of information

Kaman and its companies do not “sell” personal information as that term is generally understood. The California Consumer Privacy Act defines the “sale” of personal information much more broadly.

You have the right to opt out of the “sale” of your personal information. In order to opt out, please e-mail us at data.privacy@kaman.com. You can also submit your request by calling our customer service line, at 1.888.914.9661, PIN: 113444.

If an authorized agent is submitting the request on your behalf, the following proof is required:

  1. Provide written instruction to the Authorized Agent, provide a copy of the written instruction to us, and verify your identity with us
  2. Provide a Power of Attorney, which meets the following requirements, to the Authorized Agent, which the Authorized Agent can provide to us.
